(Jill McLaughlin via The Epoch Times) JUL 03, 2023<\/pre>\n<p>If enough residents support the idea, the\u00a0<a href=\"https:\/\/eldoradostate.substack.com\/p\/causes-for-action-to-create-a-new\">Republic for El Dorado State<\/a>\u00a0group will take the matter directly to Congress, bypassing the state Legislature that has squashed numerous past attempts.<\/p>\n<p><em><strong>\u201cWe\u2019re trying to find a way for it to happen without having to go to California on our knees, begging for them to release us. Because we know they will not,\u201d\u00a0<\/strong><\/em>one of the organizers, Sharon Durst, told The Epoch Times.<\/p>\n<p>The county encompasses about\u00a0<a href=\"https:\/\/www.edcgov.us\/Government\/Pages\/About_Us.aspx\">1,800 square miles<\/a>\u00a0along the Sierra Nevada and includes South Lake Tahoe, Placerville, Pollock Pines, Fallen Leaf, Meeks Bay and many other small towns and villages.<\/p>\n<p>Today, the rural county of less than 200,000 people attracts tourists to its wine country and recreational offerings.<\/p>\n<p><a href=\"https:\/\/www.zerohedge.com\/s3\/files\/inline-images\/id5368399-Screen-Shot-2023-06-30-at-3.32.32-PM-1200x648.png?itok=CUHn3ARN\" data-image-external-href=\"\" data-image-href=\"\/s3\/files\/inline-images\/id5368399-Screen-Shot-2023-06-30-at-3.32.32-PM-1200x648.png?itok=CUHn3ARN\" data-link-option=\"0\"><picture><img decoding=\"async\" class=\"inline-images image-style-inline-images\" src=\"https:\/\/assets.zerohedge.com\/s3fs-public\/styles\/inline_image_mobile\/public\/inline-images\/id5368399-Screen-Shot-2023-06-30-at-3.32.32-PM-1200x648.png?itok=CUHn3ARN\" alt=\"\" width=\"500\" height=\"270\" data-entity-type=\"file\" data-entity-uuid=\"9b918bac-84bf-4213-a672-aaaea9262261\" data-responsive-image-style=\"inline_images\" \/><\/picture><\/a><\/p>\n<p><em>(Google Maps\/Screenshot via The Epoch Times)<\/em><\/p>\n<p>According to the website for the group,\u00a0\u201cThe residents of El Dorado County have no local state or congressional representation. None of the state or federal representatives that serve El Dorado County, live in El Dorado County.\u201d<\/p>\n<p>They also say the \u201cinvasion\u201d at the state\u2019s border, sanctuary policies, and rampant crime violate the county\u2019s rights.<\/p>\n<p>The group has only officially met once in May but are planning to hold another town hall July 10.<\/p>\n<p>If allowed to secede, El Dorado State could create its own constitution and a style of living that the locals want, according to Durst.<\/p>\n<p>Their interpretation of California\u2019s Constitution guarantees them a republican form of government, meaning their voice should be represented\u2014but this isn\u2019t happening, Durst said. For example, their state senator in District 4, which stretches across 13 counties, Sen. Marie Alvarado-Gil (D-Jackson), represents around 1 million residents.<\/p>\n<p>The group also argues they are guaranteed to have Congress help them with foreign invasions and domestic violence, both of which are rampant in the state with the influx of undocumented immigrants and skyrocketing crime, Durst said.<\/p>\n<p><em><strong>\u201cRight now, people are leaving California, but we don\u2019t want to leave our homes, we don\u2019t want to leave what we\u2019ve built. (Justin Sullivan\/Getty Images)<\/em><\/p>\n<h2>Making Economic Sense<\/h2>\n<p>Former county supervisor Ray Nutting, who was\u00a0<a href=\"https:\/\/www.edcgov.us\/County%20Press%20Releases\/Pages\/el_dorado_county_district_attorney_vern_pierson_announces_the_arrest_of_el_dorado_county_supervisor_ray_nutting.aspx\">arrested<\/a>\u00a0in 2013 and later acquitted of charges related to receiving state grants, is helping to organize the economics side of the plan.<\/p>\n<p><em><strong>\u201cWe have an economic base that is renewable in terms of agriculture, tourism, and water supply,\u201d<\/strong><\/em>\u00a0he told The Epoch Times.<\/p>\n<p><em><strong>\u201cWe are very blessed in terms of who we are in El Dorado County, and our tax base absolutely will be enough to deliver critical services.\u201d<\/strong><\/em><\/p>\n<p>He sees taxes going down for residents if they split from California. The state\u2019s income, sales, and gas taxes are some of the highest in the nation. Those are on top of assorted fees for electricity usage, businesses, climate action, and many other fees and charges.<\/p>\n<p>A recent increase in the state\u2019s housing regulations and mandates requiring low-income housing and high-density developments are also expensive, Nutting said.<\/p>\n<p>Nutting\u2019s children are fifth-generation ranchers, and he has taught them to care for the land, he said.<\/p>\n<p><em><strong>\u201cWe have a chance to take care of the land better than the state of California,\u201d<\/strong><\/em>\u00a0Nutting said.<\/p>\n<p>The proposed secession would hinge on\u00a0<a href=\"https:\/\/constitution.congress.gov\/browse\/article-4\/section-3\/clause-1\/#:~:text=New%20States%20may%20be%20admitted,as%20well%20as%20of%20the\">Article 4<\/a>, section 3, clause 1, which provides the process of forming new states. (Jane Tyska\/Bay Area News Group via AP)<\/em><\/p>\n<p>The second clause\u2014<a href=\"https:\/\/constitution.congress.gov\/browse\/article-4\/section-3\/clause-2\/#:~:text=The%20Congress%20shall%20have%20Power,or%20of%20any%20particular%20State.\">Article 4<\/a>, section 3, clause 2\u2014states that Congress shall have the power to dispose of and make all needful rules and regulations respecting the territory or other property belonging to the United States.<\/p>\n<p>The group points to the fact that 46 percent of the land in El Dorado County is federal forest land, and the county was formed before the state. Nutting said he believes the county could use this clause to go straight to Congress, although he said they will have to obtain expert legal advice at some point.<\/p>\n<h2>Law Professor Disagrees<\/h2>\n<p>Margaret Russell, a law professor at Santa Clara University and constitutional law expert, said this language does not allow counties to go directly to Congress.<\/p>\n<p><em><strong>\u201cI think this is a non-starter of an argument for them,\u201d<\/strong><\/em>\u00a0Russell told The Epoch Times.<\/p>\n<p>There\u2019s no such thing as a county in the constitutional structure, she added. \u201cThey derive their power from the state.\u201d<\/p>\n<p>The U.S. Constitution doesn\u2019t say anything about the role of counties and makes it clear the state is the relevant stakeholder, she said.<\/p>\n<p>As for representation, the state mirrors the structure of Congress. This allows representation based on population and representation in the Senate based on equalizing power across the government, according to Russell.<\/p>\n<h2>Pioneering Spirit<\/h2>\n<p>The group is circulating a survey to find out how many of their neighbors support the idea. So far, they have received positive feedback and few negative comments, according to Durst. They expect to take about a year to organize what they need to petition Congress, she said.<\/p>\n<p>\u201cSo many of these \u2018<a href=\"https:\/\/www.theepochtimes.com\/t-new-california\">separate from California<\/a>\u2018 movements linger on and on, and we don\u2019t want to do that,\u201d Durst said.\u00a0<em><strong>\u201cWe want to know fairly quickly, do the people of [El Dorado County] see an advantage to leaving California as a new state.\u201d<\/strong><\/em><\/p>\n<p><a href=\"https:\/\/www.zerohedge.com\/s3\/files\/inline-images\/2023-07-03_07-25-45.jpg?itok=YWf2bKv8\" data-image-external-href=\"\" data-image-href=\"\/s3\/files\/inline-images\/2023-07-03_07-25-45.jpg?itok=YWf2bKv8\" data-link-option=\"0\"><picture><img decoding=\"async\" class=\"inline-images image-style-inline-images\" src=\"https:\/\/assets.zerohedge.com\/s3fs-public\/styles\/inline_image_mobile\/public\/inline-images\/2023-07-03_07-25-45.jpg?itok=YWf2bKv8\" alt=\"\" width=\"500\" height=\"281\" data-entity-type=\"file\" data-entity-uuid=\"cf144da8-2a00-4db4-9d3e-1cda08bc32a4\" data-responsive-image-style=\"inline_images\" \/><\/picture><\/a><\/p>\n<p><em>Bill Roberts holds an American flag in front of his house in South Lake Tahoe, Calif., on Aug. 31, 2021. (Terry Chea\/AP Photo)<\/em><\/p>\n<p>The group\u2019s trailblazing spirit is reminiscent of the efforts made by forefathers of the region, who came out west seeking riches during the Gold Rush of the late 1840s and early 1850s, she said.<\/p>\n<p><em><strong>\u201cWe still have that pioneer spirit in El Dorado County,\u201d<\/strong><\/em>\u00a0Durst said.<\/p>\n<p>Her great-great grandmother arrived in the county in a covered wagon, she said. Durst was born just west of the area in Sutter County and moved back after she retired from her job in Sacramento.<\/p>\n<p>The secession isn\u2019t about politics\u2014Durst isn\u2019t a Republican or a Democrat. The state has always been too big, she said.<\/p>\n<p><em><strong>\u201cThe Declaration [of Independence] gave us freedom and liberty from King George, and we want freedom and liberty from the state of California,\u201d\u00a0<\/strong><\/em>Durst said.<\/p>\n<p>Talk of\u00a0<a href=\"https:\/\/www.library.ca.gov\/collections\/online-exhibits\/splitting-ca\/\">splitting<\/a>\u00a0up the Golden State has been floated many times before this, reaching back to when the territory first became a state in 1850.
