(InEDC) ZACH SCHONFELD - 07\/28\/23 4:58 p.m. ET<\/pre>\n<p>Justice\u00a0<span class=\"person-popover\" data-nid=\"16128\"><a class=\"person-popover__link\" href=\"https:\/\/thehill.com\/people\/samuel-alito\/\">Samuel Alito\u00a0<\/a><\/span>said Congress has \u201cno authority\u201d to regulate the Supreme Court in an interview with the Wall Street Journal\u2019s opinion section published Friday, pushing back against Democrats\u2019\u00a0<a href=\"https:\/\/thehill.com\/homenews\/senate\/4108246-senate-judiciary-panel-advances-supreme-court-ethics-reform-bill\/\" target=\"_blank\" rel=\"noreferrer noopener\" data-type=\"URL\" data-id=\"https:\/\/thehill.com\/homenews\/senate\/4108246-senate-judiciary-panel-advances-supreme-court-ethics-reform-bill\/\">attempt to mandate<\/a>\u00a0stronger ethics rules.<\/p>\n<p>Alito, one of the high court\u2019s leading conservatives, is just one of multiple justices who have come under recent scrutiny for ethics controversies that have fueled the renewed push.<\/p>\n<p>\u201cI know this is a controversial view, but I\u2019m willing to say it,\u201d Alito\u00a0<a href=\"https:\/\/www.wsj.com\/articles\/samuel-alito-the-supreme-courts-plain-spoken-defender-precedent-ethics-originalism-5e3e9a7?\" target=\"_blank\" rel=\"noreferrer noopener\">told the Journal<\/a>. \u201cNo provision in the Constitution gives them the authority to regulate the Supreme Court \u2014 period.\u201d<\/p>\n<p>Although the Constitution enables Congress to structure the lower federal courts, it explicitly vests judicial power within a singular Supreme Court.<\/p>\n<p>Alito and some legal observers argue that means Congress can\u2019t prescribe certain regulations for the high court without running afoul of separation of powers issues.<\/p>\n<p>Chief Justice\u00a0<span class=\"person-popover\" data-nid=\"13644\"><a class=\"person-popover__link\" href=\"https:\/\/thehill.com\/people\/john-roberts\/\">John Roberts\u00a0<\/a><\/span>has also questioned Congress\u2019s ability to act, but not as definitive as Alito\u2019s new remarks. Many court watchers who disagree with the premise believe that Roberts\u2019 questioning has given fodder to Republican objections.<\/p>\n<p>\u201cI don\u2019t know that any of my colleagues have spoken about it publicly, so I don\u2019t think I should say,\u201d Alito told the paper. \u201cBut I think it is something we have all thought about.\u201d<\/p>\n<p>Rep. Alexandria Ocasio-Cortez (N.Y.) was among the Democrats who rejected Alito\u2019s reasoning,\u00a0<a href=\"https:\/\/twitter.com\/AOC\/status\/1685028166593613824\" target=\"_blank\" rel=\"noreferrer noopener\" data-type=\"URL\" data-id=\"https:\/\/twitter.com\/AOC\/status\/1685028166593613824\">writing on X<\/a>, formerly known as Twitter, \u201cWhat a surprise, guy who is supposed to enforce checks and balances thinks checks shouldn\u2019t apply to him.\u201d<\/p>\n<p>The piece also revealed Alito\u2019s first public comments on the recent ethics push since he authored an op-ed for the same paper\u00a0that was shared just before\u00a0a ProPublica investigation into an undisclosed Alaskan fishing trip the justice accepted in 2008 paid for by a conservative donor\u00a0was made public. Alito also conducted an interview with the Wall Street Journal in April.<\/p>\n<p>One of the two authors of the piece, David Rivkin, is an attorney for conservative judicial activist Leonard Leo. Rivkin earlier this week\u00a0<a href=\"https:\/\/thehill.com\/regulation\/court-battles\/4120303-conservative-activist-dismisses-democrats-request-for-information-on-alito-fishing-trip\/\" target=\"_blank\" rel=\"noreferrer noopener\">penned a letter<\/a>\u00a0rebuffing Democratic lawmakers\u2019 request for information about the Alaska trip, which Leo reportedly facilitated, and Rivkin also actively practices before the court. James Taranto, the other author, is the Journal\u2019s editorial features editor.<\/p>\n<p>\u201cI marvel at all the nonsense that has been written about me in the last year,\u201d Alito said.<\/p>\n<p>The revelations about the Alaska trip followed a ProPublica investigation into luxury trips accepted by fellow conservative Justice Clarence Thomas.
