(Bogle) that was based on a supposed violation of Business and Professions Code \u00a725502(a)(2), and the department sought a writ of review in the appeals court\u2014which it issued. \u201cWe agree with the Board that the Department erred, and therefore reverse the Department\u2019s decision and affirm the Board\u2019s decision,\u201d Justice Peter A. Krause wrote.<\/p>\n<h3>Wording of Statute<\/h3>\n<p><em>Sec. 25502 provides:<\/em><\/p>\n<p>\u201ca) No manufacturer, winegrower, manufacturer\u2019s agent, California winegrower\u2019s agent, rectifier, distiller, bottler, importer, or wholesaler, or any officer, director, or agent of any such person, shall, except as authorized by this division: [\u00b6]\u2026[\u00b6] (2) Furnish, give, or lend any money or other thing of value, directly or indirectly, to\u2026any person engaged in operating, owning, or maintaining any off-sale licensed premises.\u201d The non-functional oven provided to a Raley\u2019s store in South Lake Tahoe was used in a display, during \u201cpizza month,\u201d featuring a Bogle-branded oven, opened and unopened cases of Bogle, wine and a Bogle-branded pennant.
