Ray Nutting arrested AGAIN - No, NOT REALLY
Nearly everyone knows that former Supervisor Ray Nutting lost his job for a technical violation involving a loan from an employee but are unaware of the actual process of arrests in El Dorado County.
Every time a citizens freedom is restricted by being taken "into custody" and they are not free to leave on their own volition, they have been arrested. In most cases, a suspect is arrested when charges are filed. This starts a paper trail allowing law enforcement to do further background checks like a fingerprint search. Most suspects are released from jail during the trial phase. If found guilty of a crime that requires serving "time" then they are re-arrested in order to serve the sentence.
In some cases, these are 'weekender' sentences where a convict will serve the time of the sentence only during successive weekends. In this case, the person will have to be arrested each time the show up on Friday evening to serve their term. This often leads the public to think a suspect has been arrested on a "New" crime not understanding that the process is that that person gets "re-arrested" each week for the old crime until the sentence is completed.
In cases like Former Supervisor Ray Nutting, his sentence is to be served under a "community work program" common for non-violent crimes. As he was processed into the program, an automatic process including the technical arrest seen in the Sheriff's Arrest Logs.
Another county process that would trigger the same notice is entering into the "house arrest/ankle bracelet" program.
This week the program was approved and Nutting was entered into the community work program and he served his first day. That also triggered him being re-arrested in technical terms and placed his name on the Arrest logs and soon people were talking about Ray Nutting being arrested again, thinking he was arrested for a new crime.
This is a very common misconception caused from the limited knowledge of the arrest log without the full understanding that many people are arrested a number of time for the same crime for what is essentially technical reasons having nothing to do with new crimes or any kind of behavior that would change a person's ability to remain free.
Ray Nutting was arrested again, but only because the program of house arrest has formally begun for the sentence of accepting a loan for bail from the wrong people.
