Investigation of EDC DA Vern Pierson Requested
The Letters are entitled, "DISTRICT ATTORNEY’S BETRAYAL OF PUBLIC TRUST"
DISCLOSURE: Cris Alarcon, the publisher of PR Pond, was a co-defendant with Dan Dellinger in the action referenced in this letter.
One was sent to: Attorney General Kamala Harris, Office of the Attorney General, P.O. Box 944255, Sacramento, CA 94244-2550. Another was sent to: President Luis J. Rodriguez, The State Bar of California, 180 Howard St., San Francisco, CA 94105, 415-538-2000. CCs included Governor Jerry Brown, Senate President pro Tem Darrell Steinberg, Assembly Speaker Toni Atkins, and many local county and City of Placerville elected officials.

It appears that District Attorney Vern Pierson maliciously prosecuted Dan Dellinger. There was no legitimate basis for the charges the DA made against Dellinger. The jury threw out the charges after an extraordinarily short 47 minutes of deliberation. The District Attorney wasted thousands and thousands of the taxpayers’ money in the process. Vern Pierson filed bogus charges in retribution for Dellinger’s successful efforts in opposing the District Attorney’s political cronies. The DA’s actions are a betrayal of public trust. They are a blatant abuse of the powers of his office. Now he cowardly hides behind immunity laws that protect him from law suits seeking compensation for the damages the DA wrongfully inflicted on Dellinger. District Attorney Vern Pierson should be investigated. He is a detriment and an embarrassment to the people of El Dorado County.

A news release, May 27, 2014, Placerville, CA stated – “After just 47 minutes, an El Dorado County jury pronounced Dan Dellinger, a government relations and political consultant often on opposite political sides of the District Attorney, not guilty on all charges in a unanimous 12-0 vindication vote late Thursday.
By clearing Dellinger and media consultant Cris Alarcon of any wrongdoing in connection with Dellinger’s Consulting Company work assisting the financially stressed Pioneer Fire Protection District pass a parcel tax known as Measure F back in 2011, the jury of 7 men and 5 women handed El Dorado County District Attorney Vern Pierson his second major defeat in as many weeks in what most observers now see as Pierson’s Soviet style show trials for self-aggrandizing publicity or simply attempted political lynching of effective opponents.
“I don’t understand why this action was brought against Dan in the first place”, pondered Ripley Howe the Chairman of the Pioneer Fire Protection District Board of Directors who testified during the trial, “our District did everything we could to follow the rules, Mr. Dellinger did everything he could to follow the rules, and the jury agreed that we did nothing wrong”.
Dellinger had been accused of expending public money and public resources for express advocacy, receiving or granting a gift of public funds, and engaging in unfair business practices. In November 2011 Pioneer Fire Protection District’s Measure F passed with a nearly 80% approval vote.
Dellinger has a long history of political clashes with El Dorado County District Attorney Vern Pierson and his political ally EDC Auditor-Controller Joe Harn including helping elect EDC Supervisor Ray Nutting and EDC Sheriff John D’Agostini over Pierson and Harn’s strongly backed candidates.”
The facts in this case support the allegation that DA Vern Pierson conducted a malicious prosecution against Dan Dellinger on bogus charges.
REQUESTED ACTION: It is requested that the State Attorney General investigate the charge that El Dorado County District Attorney, Vern Pierson, carried out a malicious prosecution against Dan Dellinger.
