Three Tahoe men sentenced in 2012 Birthday death
A plea deal was reached recently, with formal sentencing Friday in Placerville for the one-time bouncers of Mo’s Place, a bar on Lake Tahoe Boulevard, according to the Lake Tahoe News. The newspaper provided this account of the sentences imposed by El Dorado Superior Court Judge James Wagoner in the death of Derek “Zippy” Penaranda, who was in South Lake Tahoe in May 2012 to celebrate his birthday:
• Rodolfo Hernandez, 44, pleaded no contest to involuntary manslaughter. He was sentenced to 364 days in jail with credit for time served and four years’ probation. He has been in custody since he turned himself in after being indicted. He will be turned over to federal custody and deported because he is in the United States illegally. The 364-day sentence allows him to seek re-entry. He had faced a maximum penalty of four years in county jail.
• Sean Canilao, 49, was sentenced to 60 days in custody starting Feb. 24, to be followed by 120 days of house arrest. He will be behind bars for 30 days and on probation for four years. He will not be allowed to own firearms or ammunition for the rest of his life. The maximum penalty was four years in prison.
• Ruben Lizzaragga, 41, was sentenced to 240 days in jail, with 60 days behind bars starting Feb. 28 and 180 days of an alternative sentence that has yet to be determined. He is also on probation for four years and will not be allowed to own a gun or ammunition. The maximum penalty was four years in prison.
