“Vern Pierson v. Ray Nutting,” a random, January 2014 perspective….- Opinion
Of the hundreds of people over the years who have been cited by the California Fair Political Practices Commission (FPPC) for violations, how many, in addition to their fines, were also prosecuted by their local DAs? Was Arnold Schwarzenegger (whose fine was $200,200.00) or Judge Allen Thomas (fine: $4,000.00)? Index IV on the FPPS’s website displays 244 pages of the names, charges and fines of people many of whom may have technically committed felonies, but were not arrested. How can this be? With the imposition of their fines they were found to be guilty. They are publically named as having filed false reports, not stating all their income and many were charged with conflict of interest. Of these, how many of them received the same treatment the DA now wants to meet out to Mr. Nutting?
Supervisor Briggs seems to be “Passing GO,” more than once lately. He has routinely voted to approve expenditures that will benefit his family’s property adjacent to the proposed Court House location. A local Realtor/Consultant was heard to comment that John Briggs committed two felonies when he purchased the parcels upon which the Court House might be built…and that he (Briggs) is now immune because the Statute of Limitations has expired….and “The Beat goes on
Auditor-Controller Harn, moonlights here while being a partner in Harn and Dolan in Walnut Creek (2423 Stirrup Court). He is legendary in his recreational exploits and financial misdeeds. How many sexual harassment complaints have been lodged against him? How many times has he been in rehab? How many millions of dollars have been lost, are unaccounted for, or are unwatched while in his care? Is the saying “If Joe doesn’t like you, you don’t stay [employed],” true? Do we even need to mention his alleged relationship with former Supervisor Helen Bauman? Why did Daniel Nielsen really leave and why is Karl Wieland so defensive about Joe’s role in that.
Cherie Raffety (wife of Mt. Democrat Editor, Mike Raffety) who is EDC’s Treasurer/Tax Collector (her office is next to Joe’s) has had some staff issues over the years that seem to have faded away quickly. Also, how it is that she was able to sell a piece of land to the County for $100,000.00 more than its appraised value? It makes one wonder.
Perhaps, he just may need to rethink his position on wasting hundreds of thousands of dollars going after Ray for signing a form upon which there was a mistake, follow the precedents set by so many other prosecutors in the past, and let the FPPC deal with those who violate their mandates. As far as the conflict of interest charge goes, they have already ruled that “…the conflict of interest prohibitions of the Act will not apply [to you]. (FPPC Case No. 13/290 Advisory Letter, June 10, 2013) If Arnold and the hundreds of others on the FPPC’s lists aren’t in jail, why should Ray Nutting be.
