ADA Lawsuit Abuse Update
Tim Roffe, June 22, 2012Tracking SB 1186.... a Bill first proposed by Senator Dutton who was later joined by Senator Steinberg (at the urging of US Senator Feinstein). The bill had passed the Senate committee by unanimous vote and is due before the Assembly next week. Since coming out of the Senate, SB 1186 has been undergoing some changes.
Originally.... it was the fact that this legislation took small steps in the correct direction to combat Lawsuit abuse that garnered my support. Unfortunately the latest version of this Bill has now been watered down to the point I cannot support it anymore. My hope is that, via pressure, the Bill will regain some legitimacy... I will be touching base with US Senator Feinsteins office to attempt to enact change.
A couple of weeks ago, I contacted all of you looking for testimonials to bring to Dan Lungren in support of HR 3356... Frankly, I received 1 (one) letter, thank you Carl. I understand as well as anyone that this is a tedious process.... one that cannot be addressed in one day, one week or even one month. I also understand the needs of family, business and day to day activities makes being involved difficult for all of us. I truly believe we can make a difference... however that does take all of us, that is simple reality. My hope is that this last incident was an anomaly... triggered by the gorgeous weather we have been having, possibly accompanied by the thought that someone else will surly respond. I will continue to do the best I can to represent all of us and remain honored to do so... however, occasionally... I will need help.
